Terms and Conditions of Flying Scot and Flyaway Parking for the Provision of Car Parking Services.
Customers are requested to read carefully the terms and conditions set out below and to follow the procedures recommended in those terms and conditions.
Conditions of Storage
Flying Scot and Flyaway Parking's insurance does not cover loose items or any mechanical/electrical failure. The Proprietors of any of the car parks cannot be held responsible for any loss or damage incurred to property left in the vehicles howsoever caused. Claims cannot be considered once the vehicle has left the premises of the car park. Please check your car before leaving.
Availability
If there are no spaces available at the car park chosen in the Booking Form, we will contact you by e-mail, telephone or letter within 48 hours to offer you an alternative car park or to inform you of "no availability" so you can make alternative arrangements.
Prices
Prices are specified on the website at the time you make the booking. If your required number of days is over the specified period you will be charged the daily rate for the number of days over the specified period. No refund for unused days. All parking charges must be paid in full before your vehicle can be removed from our car park. Any special offers available will be posted on the website for the car park concerned. Commercial vehicles ie vans, pickups and camper vans are no longer accepted - if you do turn up in what is classed a large, long wheel base or a commercial vehicle (which does not fit in a regular parking space), you may be turned away or charged a surcharge of £25 (subject to change) on check in at the car park.
VAT
The price for the services includes VAT at the current UK rate.
Payment
Payment accepted on arrival at the car park, we accept cash, cheque or any of the major credit cards. Payment can also be made in advance by using the online booking form (optional) or by postal booking form. The online booking form only accepts credit/debit card payments. Postal booking forms are available on request by phoning the appropriate car park. Cheques require 7 days to clear so must be sent with sufficient time to clear otherwise you may not have a reserved parking space. All cancellations of pre paid bookings must be in writing. No refunds on cancellations within 7 days of departure. Cancellations of bookings outwith this period will be given credit to the original value for future use.
Online Booking Form
Upon receipt of the booking form you will receive a confirmation by e-mail including your booking number, the number of days parking and the costs. This confirmation indicates a parking space has been reserved for you. You must include a valid e-mail address. Failure to turn up on the day of your booking will mean we have the right to offer your space to somebody else. Information you send on the booking form will be treated within the guidelines set out in the privacy statement.
The Company's Liabilities
The company, its servants and agents will accept liability in respect of the death of or personal injury sustained by the customer and others in the car park, only where the same is proved and to the extent that is proved to be caused by negligence, wilful default or breach of statutory duty of the company, its servants or agents.
The company, its servants or agents will have no liability of these terms and conditions in respect of:
(a) any loss or damage to goods or property of whatsoever description which has been left in the customer's vehicle, irrespective of the cause of that loss or damage, and in particular, and without prejudice to the foregoing generality, whether or not that loss or damage has been caused by negligence, wilful default or breach of statutory duty of the company, its servants or agents or the dishonesty of its servants or agents;
(b) windscreens / any glass damage / tyres;
(c) any damage to items in the luggage compartment of the coach.
(d) On arrival customers should park in Customer Arrivals at Reception area, where you should check in and leave your keys with reception staff.
You will receive a ticket with instructions for the procedure when you return to Glasgow Airport.
(e) The Company cannot be held responsible if you lose your return instructions/numbered receipt and this is presented to the Company by a third party who uses it to fraudulently take delivery of your car. Your attention is drawn to this exclusion of liability in our Booking Forms and notices at the car park.
(f) The Company does not accept any responsibility or liability for delays of its services , caused as a result of circumstances beyond its control such as traffic congestion, road accidents, delayed flights, security alerts, severe weather conditions, luggage delays and immigration delays.
(g) The Company only carries such Public Liability Insurance as is required by law. This means that in neither case does it cover any damage to or theft from any Vehicle. In no circumstances will the Company be responsible for any such matter or for consequential or indirect losses such as car hire or hotel charges. The Company only accepts liability for any damage to Vehicles caused by the proven gross negligence of its employees. You should not leave any items of value in or on your Vehicle. You are reminded that your motor insurance policy may not cover possessions in your vehicle. It may be possible to arrange separate insurance cover for such possessions and we encourage you to do so. We do not accept any liability other than in respect of liability which cannot be excluded by law.
(h) Should you damage another Vehicle or any part of a Car Park you must report the matter immediately to a member of Our staff and give him or her the registration numbers of both Vehicles together with your full name and address and the name and address of your insurance company together with your policy number. In doing so, for the purposes of the Data Protection Act 1998 and any other relevant law you are consenting to Our passing this information on to the owner or driver of any other Vehicle involved and to any insurers (including Our insurers), and if We consider it appropriate, to the Police.
(i) We cannot guarantee the security of our Car Parks as members of the public could have access to them at all times. We do not guarantee to you that security measures that we have in place, for example CCTV or patrols, will be working at all times or, even if they are working that they will be effective in preventing loss, damage, or theft or in identifying who might be to blame. Where CCTV cameras are installed in any of the Car Parks they are used to assist in the proper running of the Car Park. The CCTV cameras may also act as a deterrent to criminal activity. We are obliged by law to display signage in the Car Park advising that CCTV cameras are in operation. However, we do not make any representation as to the extent of coverage provided by the cameras and no guarantee is given as to the security of your vehicle in Car Parks where CCTV is installed.
The customer expressly acknowledges that the provisions of this condition satisfy the requirements of reasonableness specified in the Unfair Contract Terms Act 1977 and that he, she or they (as the case may be) shall be banned from claiming the contrary at any future date in the event of any future date in the event of any dispute with the company concerning liability hereunder.
Vehicles that are "self-parked" will not be inspected by a member of staff for pre-existing damage. Self-parked vehicles are left at their own risk.
Liens
Every vehicle in the car park is subject to lien for all charges due or accruing due from the Customer to the Company, and a general lien for all and any monies due from the Customer to the Company, such liens to be in existence whenever the Vehicle is in the car park, notwithstanding that it may from time to time have been removed from the car park. If the said lien is not satisfied by payment within 28 days given by the Company of its intention to sell the Vehicle in default of payment the Company may sell the Vehicle by auction or otherwise and the proceeds of the sale may be applied in the expense of the same and in connection with such sale the Company shall be entitled to charge reasonable garage charges in respect of the period during which the Vehicle is in possession of the Company. Any balance or purchase price remaining after satisfaction of such sums shall be held by the Company on behalf of the registered owner of the Vehicle.
Notice of intention as aforesaid shall be given to the Customer by the sending of a written notice by pre paid post address to the customer at the address given by the customer such notice shall be deemed to have been served upon the expiration of 48 hours after posting.
Movement
The Company reserves the right to move the Vehicle within the car park or elsewhere by driving or otherwise to such an extent on the Company, its servants or agents may in discretion think necessary to avoid obstruction or for the efficient arrangement of the car parking facilities.
To the extent that it may be necessary to do so in the exercise of the rights conferred upon the Company under this condition the Company, its servants or agents shall have the right to drive or otherwise take the Vehicle on the public highway.
Transport
The clients agree to share transport to and from the airport.
You are advised to allow for sufficient journey time to arrive at the car park at least 20 minutes prior to the check-in time, which is normally at least two hours before your scheduled flight departure, given to you by your airline, travel operator or travel agent. Whilst a map and directions to the car parks are usually provided by way of assistance to you, the Company cannot in any circumstances be held liable for any loss you might suffer should you get lost and miss your flight.
Express Transfers
Please note that express transfer additions to bookings are only transferable to different times or dates subject to availability. You must check in at the car park within 15 minutes of the time you have stated on bookings made for express transfers to Glasgow Airport, otherwise we may be unable to offer the service.
Release of Vehicles
The company reserves the right to refuse to release any vehicle except on the production of the parking receipt until it has made such enquiries as it considers reasonable. Failure to produce this receipt will therefore delay departure from the car park.
If customers request other persons to collect their vehicles for them they must provide written consent before leaving their vehicle. The person collecting the vehicle must have a copy of this written consent otherwise the Company can refuse to release the vehicle to them. Full Terms and Conditions are available on request.
Changes to the Terms and Conditions
We reserve the right to make changes to these terms and conditions or policies regarding the use of the website, any changes to the Terms and Conditions will be posted on this page.
